Supreme Court opens case against PSOE senator for proposing wife as peace judge

The Supreme Court’s Criminal Chamber has admitted a complaint from prosecutors against PSOE senator Alfonso Carlos Moscoso for proposing his wife for the post of peace judge in Villaluenga del Rosario.

The court will also investigate the senator’s wife for an alleged offence of public officials’ prevarication. The facts maintain an inseparable material connection with those attributed to the parliamentarian, according to the ruling. The events date back to November 2022, when the Villaluenga del Rosario town council announced the post and no candidate came forward among the 464 residents. The mayor’s wife, a PSOE member since October 2007, submitted her application. The plenary approved the sole candidacy unanimously on 30 March 2023 and the Superior Court of Justice of Andalusia appointed her on 4 July 2023. She took office on 22 July that year and resigned on 2 May 2025. The Supreme Court recalls that the Organic Law of the Judiciary and the peace judges’ regulations prohibit membership of political parties. Prosecutors maintain that the woman continued to attend PSOE events during her term. Article 405 of the Criminal Code punishes with a fine and suspension from office anyone who proposes a person lacking legal requirements.
