CNJ removes TJMG judge over suspected favoritism in 123 Milhas case

Brazil's National Justice Council (CNJ) ordered the precautionary removal of TJMG judge Alexandre Victor de Carvalho over suspicions of favoritism in the 123 Milhas judicial recovery process. The decision came from Justice Minister Mauro Campbell. The Minas Gerais Court of Justice (TJMG) said it has appointed a replacement and will comply.

The CNJ removed TJMG Justice Alexandre Victor de Carvalho on Monday (30) after probing irregularities in the 123 Milhas case. The precautionary measure targets a potential pattern of conduct breaching judicial duties, per the council.

The complaint came from Brisola e Japur firm, alleging Carvalho appointed judicial administrators replacing first-instance court aides, violating the natural judge principle. He also reportedly approved a R$ 23 million release for fees during the court recess. Carvalho, former head of São Paulo's 1st Bankruptcy Court until December 2023, dismissed the claims as "absurd and frivolous" and provided detailed rebuttals.

TJMG stated it has taken steps to comply, appointing a replacement, and reaffirmed its commitment to legality. Carvalho was previously removed in December 2024 over irregular family hires.

The 123 Milhas recovery process started in August 2023 with R$ 2.3 billion in debts and 761,293 creditors. The plan was filed in December 2024 at Belo Horizonte's 1st Business Court.
