The Western Cape High Court granted President Cyril Ramaphosa an interdict on 24 July 2026 to halt Parliament’s Section 89 impeachment committee from proceeding with a public inquiry into the Phala Phala matter.
The majority judgment by Judges Andre le Grange and Diane Davis ordered the interdict of limited duration pending Ramaphosa’s review application of the Section 89 panel report. The review is scheduled for early September. Judge Matthew Francis dissented, arguing that the president would not suffer irreparable harm.
Ramaphosa sought the interdict after a Constitutional Court ruling in May directed Parliament to establish the committee. The panel, led by former Chief Justice Sandile Ngcobo, found he had a case to answer over the theft of $580,000 at his Phala Phala farm.
The African Transformation Movement, Economic Freedom Fighters, uMkhonto weSizwe and United African Transformation opposed the application. Committee chair Makashule Gana said the parties would study the full judgment. The Presidency stated that Ramaphosa reaffirms his respect for judicial independence.
