Ramaphosa obtient une injonction de la Haute Cour pour bloquer l'enquête en destitution

La Haute Cour du Cap-Occidental a accordé au président Cyril Ramaphosa une injonction le 24 juillet 2026 pour suspendre la commission de destitution de l'article 89 du Parlement, l'empêchant de procéder à une enquête publique sur l'affaire Phala Phala.

Le jugement majoritaire des juges Andre le Grange et Diane Davis a ordonné l'injonction de durée limitée dans l'attente de la demande de révision par Ramaphosa du rapport du panel de l'article 89. La révision est prévue pour début septembre. Le juge Matthew Francis a exprimé son désaccord, arguant que le président ne subirait pas de préjudice irréparable.

Ramaphosa a sollicité cette injonction après qu'une décision de la Cour constitutionnelle en mai a ordonné au Parlement de mettre en place la commission. Le panel, dirigé par l'ancien juge en chef Sandile Ngcobo, a conclu qu'il devait répondre de ses actes concernant le vol de 580 000 dollars dans sa ferme de Phala Phala.

L'African Transformation Movement, les Economic Freedom Fighters, uMkhonto weSizwe et United African Transformation se sont opposés à la demande. Le président de la commission, Makashule Gana, a déclaré que les partis étudieraient le jugement complet. La présidence a indiqué que Ramaphosa réaffirme son respect pour l'indépendance judiciaire.
