La justice examine la demande de Ramaphosa visant à suspendre la procédure de destitution liée à Phala Phala

La Haute Cour du Cap-Occidental a entendu mercredi les arguments concernant la requête urgente du président Cyril Ramaphosa visant à stopper la procédure parlementaire de destitution liée à l'affaire Phala Phala.

Des partis d'opposition, dont l'African Transformation Movement, les Economic Freedom Fighters, uMkhonto weSizwe et United Africans Transformation, se sont opposés à l'injonction. Les avocats ont soutenu qu'une telle décision empiéterait sur les prérogatives du Parlement et violerait le principe de séparation des pouvoirs. Ramaphosa cherche à suspendre le processus dans l'attente de son examen en septembre du rapport de la commission de l'article 89, dirigé par l'ancien juge en chef Sandile Ngcobo, qui a conclu qu'il devait répondre de ses actes concernant le vol de 580 000 dollars dans sa ferme. Son équipe juridique a fait valoir que des audiences publiques causeraient un préjudice irréparable à sa réputation. Les juges Andre Le Grange, Matthew Francis et Diane Davis ont présidé l'audience. La cour reprendra ses travaux jeudi pour la réplique de Ramaphosa. Environ 40 membres du MK ont manifesté à l'extérieur pour réclamer sa démission.
