Ramaphosa gewinnt High Court-Verfahren zur Blockierung des Amtsenthebungsverfahrens

Der Western Cape High Court erließ am 24. Juli 2026 eine einstweilige Verfügung für Präsident Cyril Ramaphosa, um das nach Artikel 89 eingerichtete Amtsenthebungskomitee des Parlaments daran zu hindern, eine öffentliche Untersuchung zur Phala-Phala-Affäre fortzusetzen.

Das Mehrheitsurteil der Richter Andre le Grange und Diane Davis ordnete die zeitlich begrenzte einstweilige Verfügung an, bis über Ramaphosas Überprüfungsantrag zum Bericht des Artikel-89-Ausschusses entschieden ist. Die Überprüfung ist für Anfang September angesetzt. Richter Matthew Francis legte eine abweichende Meinung dar und argumentierte, dass dem Präsidenten kein irreparabler Schaden entstünde.

Ramaphosa hatte die einstweilige Verfügung beantragt, nachdem der Constitutional Court im Mai das Parlament angewiesen hatte, den Ausschuss einzusetzen. Das Gremium unter der Leitung des ehemaligen Chief Justice Sandile Ngcobo kam zu dem Schluss, dass er sich aufgrund des Diebstahls von 580.000 US-Dollar auf seiner Farm Phala Phala verantworten müsse.

Die African Transformation Movement, Economic Freedom Fighters, uMkhonto weSizwe und die United African Transformation sprachen sich gegen den Antrag aus. Der Ausschussvorsitzende Makashule Gana erklärte, die Parteien würden das vollständige Urteil prüfen. Das Präsidialamt teilte mit, dass Ramaphosa seinen Respekt für die Unabhängigkeit der Justiz bekräftige.
