TSE requires big techs to explain electoral content moderation

The Superior Electoral Court ordered platforms with over 5 million monthly users to detail how they will comply with electoral propaganda rules this year. The ordinance signed by President Kassio Nunes Marques on Tuesday (28) is unprecedented and demands specific reports from the companies.

The measure affects Meta, Google, X, TikTok, Kwai and artificial intelligence companies such as OpenAI and Anthropic. The companies must submit by August 16 a compliance plan describing moderation criteria, risk detection and false positive rates.

After the election, by December 19, a consolidated report on implementation will be required. Only the TSE will have access to data on tests of generative AI systems, which check for generation of content favorable to candidacies or non-consensual sexual content.

Meta and Kwai indicated they will run political ads. Google stated it has not promoted such content since 2024. Some platforms signed voluntary memoranda with the court, but X limited itself to providing an email address for complaints without integrating the Electoral Disinformation Alerts System.
