Minister Luiz Fux followed rapporteur Cármen Lúcia's vote at the Federal Supreme Court, forming a 2-0 score for unconstitutionality of changes to the Ficha Limpa Law approved by Congress in 2025.
The judgment concerns Complementary Law No. 219/2025, which changed the counting of the ineligibility period and created a 12-year cap in cases of successive convictions for administrative improbity.
Cármen Lúcia stated that the changes represent a setback to republican principles, administrative probity and public morality.
The direct action of unconstitutionality was filed by the Rede Sustentabilidade party in November 2025. The Attorney General's Office spoke on January 6, 2026, in favor of granting an injunction.
