Fux stimmt mit Cármen Lúcia für die Aufhebung der Änderungen am Ficha-Limpa-Gesetz

Der Minister Luiz Fux folgte dem Votum der Berichterstatterin Cármen Lúcia am Obersten Bundesgericht und sorgte damit für eine 2:0-Entscheidung zur Verfassungswidrigkeit der vom Kongress im Jahr 2025 verabschiedeten Änderungen des Ficha-Limpa-Gesetzes.

Das Urteil betrifft das Ergänzungsgesetz Nr. 219/2025, welches die Berechnung der Dauer der Wählbarkeitsbeschränkung änderte und eine Obergrenze von 12 Jahren für Fälle aufeinanderfolgender Verurteilungen wegen administrativer Unehrlichkeit einführte. Cármen Lúcia erklärte, dass die Änderungen einen Rückschlag für republikanische Prinzipien, administrative Redlichkeit und die öffentliche Moral darstellen. Die Verfassungsklage wurde im November 2025 von der Partei Rede Sustentabilidade eingereicht. Die Generalstaatsanwaltschaft sprach sich am 6. Januar 2026 für die Gewährung einer einstweiligen Verfügung aus. Zu den Politikern, die davon profitieren könnten, gehören Anthony Garotinho, Eduardo Cunha und José Roberto Arruda.
