The Supreme Federal Court formed a majority to allow payment of unused vacation, prize leave and accumulated court shifts before the new rules. The position prevailed after the vote of Minister Luiz Fux on Saturday, 27.
The majority of ministers, including Alexandre de Moraes, Flávio Dino, Cristiano Zanin, Gilmar Mendes and Edson Fachin, defended that payments be limited to 35% of the monthly subsidy, now at R$ 46.366,19. Luiz Fux disagreed and defended the full amount without a cap.
The judgment analyzes appeals against the March decision and runs until Tuesday, 30, with pending votes from Cármen Lúcia, André Mendonça and Kassio Nunes Marques. The National Justice Inspectorate will have 30 days to present a list of benefits with verified legality.
