The Sala II of the Cámara de Apelación en lo Civil, Comercial y Laboral of Rafaela suspended the bidding process for SanCor Cooperativas Unidas Limitada assets. The measure responds to an appeal filed by FIDULAC S.A., a company of businessman Gustavo Scaglione.
The court granted suspensive effect to the appeal against the June 11 resolution issued by judge Marcelo Gelcich. That resolution had approved the bidding terms for selling the assets in seven lots with a base of US$ 52.1 million.
Judges María José Álvarez Tremea, Duilio Maximiliano Hail and Pablo Lorenzetti found that the first-instance judge committed an excess of formal rigor by rejecting FIDULAC's challenge over an electronic signature issue on the DocuSign platform.
The Chamber ordered the case file to be elevated to decide the merits of the appeal. The suspension will remain in place until a final ruling on the validity of the bidding process is issued.
