Nintendo is asking a court to throw out a class-action lawsuit that demands the company pass along tariff refunds to consumers who bought its products at higher prices.
The Japanese gaming giant filed a motion to dismiss the suit, arguing that buyers received exactly what they paid for when prices rose last year on the original Nintendo Switch models and related accessories.
Nintendo stated that the price adjustments were modest and selective, and that it absorbed tariff costs on some popular items including the Nintendo Switch 2 console. The company noted it did not simply add the full tariff amount to each product price, unlike many competitors.
The tariffs were later ruled illegal by the US Supreme Court earlier this year. Nintendo sued the government in March seeking refunds, while the consumer class-action was filed in April.
Nintendo also argued that calculating exact tariff amounts tied to each price increase would be impossible and recommended the matter move to private arbitration.
