The Court of Appeals of Santiago unanimously rejected the amparo filed by Arnaldo Domínguez. The former territorial advisor to ex-deputy Joaquín Lavín had sought to overturn his pretrial detention at Santiago Uno prison.
Ministers Juan Cristóbal Mera, Sandra Araya and Matías de la Noi ruled that the defense arguments belong in an appeal rather than an amparo action. The decision noted that the guarantee court had explained its reasons for the pretrial detention, referencing evidence presented by the Public Ministry on the investigated crimes.
Domínguez was charged on May 4 with fraud against the State, together with former deputy Lavín, and has remained in pretrial detention since then. His lawyers claimed the ruling lacked adequate grounds.
The court clarified that disagreement with judicial reasoning does not amount to a lack of motivation. It therefore upheld the pretrial detention of the former official.
