Corte de Santiago rechaza amparo del exasesor de Lavín

La Corte de Apelaciones de Santiago rechazó de forma unánime el recurso de amparo presentado por Arnaldo Domínguez. El exasesor territorial del exdiputado Joaquín Lavín solicitaba dejar sin efecto su prisión preventiva en la cárcel Santiago Uno.

Los ministros Juan Cristóbal Mera, Sandra Araya y Matías de la Noi determinaron que los argumentos de la defensa corresponden a un recurso de apelación y no a una acción de amparo. La resolución señaló que el tribunal de garantía sí expuso las razones para mantener la medida cautelar, citando antecedentes del Ministerio Público sobre los delitos investigados.

Domínguez fue formalizado el 4 de mayo por fraude al Fisco, junto al exdiputado Lavín, y desde entonces permanece en prisión preventiva. La defensa alegaba que la resolución carecía de fundamentación suficiente.

El fallo aclara que la discrepancia con los razonamientos judiciales no equivale a una ausencia de motivación. Por ello, el tribunal mantuvo la prisión preventiva del exfuncionario.
