The Federal Supreme Court resumed on Wednesday (10) the judgment of appeals against the 2025 decision on platform liability for third-party content.
The plenary is analyzing 12 declaration embargoes filed by Facebook, Google and entities such as Abraji. Minister Dias Toffoli began reading his 75-page vote and proposed limiting the requirement for a headquarters in Brazil only to platforms with economic interest in the country. Alexandre de Moraes expressed concern with the suggestion. He defended the court's original wording, arguing that ideological crimes, such as Nazi messages, also require legal representation to comply with court orders. Toffoli said the issue is delicate and that he will continue the vote in Thursday's (11) session. The judgment also addresses deadlines for implementing the rules and requirements for extrajudicial notifications for content removal.
