Amazonas judge censors Folha report on Incra director

Judge Paulo Fernando de Britto Feitoza from the Amazonas Court of Justice ordered the removal of a Folha report on an Incra process involving relatives of Daniel Vorcaro from Banco Master. The ruling affects publications on the Folha website, in Jornal de Brasília, and on social network X, with a 24-hour deadline under threat of a daily fine of R$ 10,000. Folha plans to appeal the decision.

In a ruling issued during an on-duty session, Judge Paulo Fernando de Britto Feitoza from the Manaus District Court granted a request from João Pedro Gonçalves da Costa, director of Incra, to censor a report published by Folha on the night of January 20, 2026. The article covered an analysis process by the National Institute for Colonization and Agrarian Reform regarding a carbon stock credit project with investors who are relatives of Daniel Vorcaro, affiliated with Banco Master.

The court order requires the removal of the report from the Folha website, its reproduction in Jornal de Brasília, and a Folha post on social network X. Media outlets are also prohibited from publishing new articles linking the director to the episode without new facts or evidence. The compliance deadline is 24 hours, with a daily fine of R$ 10,000 for non-compliance.

In the decision, the judge stated that the publication has a 'defamatory and slanderous bias', improperly associating the plaintiff's image. 'Freedom of expression and the press does not authorize the imputation of illicit or disreputable conduct dissociated from the factual-documentary context, especially when directed at a public agent,' wrote Feitoza, emphasizing the violation of personality rights.

The judge justified the urgency due to the 'probability of the right and the danger of damage', asserting that the publications exceed the duty to inform and tarnish the director's objective honor and professional image, in a position of high responsibility. Folha intends to file a reconsideration request, to be reviewed by the judge handling the case.
