L'OSG a soutenu que les Philippines restent légalement tenues de coopérer avec la CPI en vertu du droit interne, en citant la loi de la République n° 9851.

Les avocats de l'État ont également contesté les allégations selon lesquelles un mandat d'un tribunal local serait nécessaire et ont soutenu que dela Rosa a bénéficié d'une procédure régulière par le biais de ses propres dépôts au tribunal. La Cour suprême devrait statuer sur la demande d'ordonnance restrictive temporaire après avoir examiné les observations.
