Colombia's Superintendencia de Industria y Comercio (SIC) has opened an investigation into Comcel S.A. (Claro) for potential irregularities in the sale of cell phones and other technological products through its online platform.
The regulator's decision followed preliminary inquiries, including information requests, analysis of financing contracts, review of advertising materials, and inspections of Claro's website. The charges include irregularities in promotion and offer information, allegedly misleading details, failure to disclose total product prices, conditioning of the right to retract, charging interest rates above legal limits, and non-compliance with e-commerce regulations.
The SIC stressed that issuing charges does not determine Claro's responsibility and that the administrative process will ensure the company's right to defense and rebuttal. This action aims to safeguard consumer rights in the telecommunications sector.
Claro has not yet issued a public statement on the investigation.
