Spain's CNMC has opened a very serious sanction file, dated April 23, against Iberdrola España and Iberdrola Generación Nuclear for possible unauthorized production cuts during the April 28, 2025 blackout—the third such case amid 56 total files opened recently in the ongoing investigation.
This latest file targets a breach of article 64.37 of the Electricity Sector Law, regarding 'reduction of production or supply without authorization/repeated failure to meet availability obligations' at Iberdrola's nuclear facilities during the blackout.
It joins two prior very serious cases: one against Red Eléctrica de España (REE) for system operator failures, and another against the Almaraz nuclear plant. The 56 files—announced in batches, including 35 last Friday—target multiple firms like Iberdrola (23 total), Endesa (17), and others, though not all tie directly to blackout day and do not assign its cause, described as multifactorial.
Very serious infractions risk fines of 6-60 million euros; proceedings last 9-18 months, with opportunities for defense.
