CNMC abre terceiro processo por infração gravíssima contra a Iberdrola nuclear em investigação sobre apagão de 2025

A CNMC da Espanha abriu um processo sancionador por infração gravíssima, datado de 23 de abril, contra a Iberdrola España e a Iberdrola Generación Nuclear por possíveis cortes de produção não autorizados durante o apagão de 28 de abril de 2025—o terceiro caso do tipo entre 56 processos abertos recentemente na investigação em curso.

Este processo mais recente foca em uma violação do artigo 64.37 da Lei do Setor Elétrico, referente à 'redução de produção ou fornecimento sem autorização/falha reiterada no cumprimento de obrigações de disponibilidade' nas instalações nucleares da Iberdrola durante o apagão.

Ele se junta a dois casos anteriores de infração gravíssima: um contra a Red Eléctrica de España (REE) por falhas do operador do sistema e outro contra a usina nuclear de Almaraz. Os 56 processos—anunciados em lotes, incluindo 35 na última sexta-feira—têm como alvo várias empresas, como Iberdrola (23 no total), Endesa (17) e outras, embora nem todos estejam diretamente ligados ao dia do apagão e não atribuam sua causa, descrita como multifatorial.

Infrações gravíssimas podem resultar em multas de 6 a 60 milhões de euros; os procedimentos duram de 9 a 18 meses, com oportunidades para defesa.
