BIR files tax evasion charges against former DPWH engineers

The Bureau of Internal Revenue has filed three separate tax evasion complaints against former Department of Public Works and Highways engineers Henry Alcantara, Brice Hernandez, and Jaypee Mendoza over a P1.6 billion tax liability. The cases are linked to alleged corruption in flood control projects. Meanwhile, the Independent Commission for Infrastructure recommended additional criminal and administrative charges against them and others.

On November 6, 2025, the Bureau of Internal Revenue (BIR) filed three separate tax evasion complaints with the Department of Justice against former Department of Public Works and Highways (DPWH) engineers Henry Alcantara, Brice Ericson Hernandez, and Jaypee Mendoza. According to the BIR, led by Commissioner Romeo Lumagui Jr., the individuals violated Section 254 of the National Internal Revenue Code by attempting to evade P1.6 billion in tax obligations from 2020 to 2024, as well as failing to supply correct information in their income tax returns.

Meanwhile, on November 7, 2025, the Independent Commission for Infrastructure (ICI) submitted its fourth interim report to the Office of the Ombudsman, recommending criminal and administrative charges against Alcantara, Hernandez, and other former engineers including Jaime Hernandez, Ernesto Galang, John Carlo Rivera, John Michael Marcos, Claudine Magdalene Magsakay, Ericka Justine Chico, and Allan Payawal. The accusations relate to a P95 million ghost flood control project in Bocaue, Bulacan, violating the Anti-Graft and Corrupt Practices Act, Malversation and Falsification provisions of the Revised Penal Code, Presidential Decree No. 1759, and the Government Procurement Reform Act.

ICI Chairman Andres Reyes Jr. stated, 'There are plenty of cases. So we can escalate in the next filing.' The ICI also recommended assessing potential liability for former DPWH Secretary Manuel Bonoan and undersecretaries Roberto Bernardo and Maria Catalina Cabral under the Code of Conduct and Ethical Standards for Public Officials and Employees. Reyes noted that a P41 million budget for the ICI would aid the investigation, which involves only 15 lawyers.

These cases form part of a broader probe into corruption at the DPWH, particularly flood control projects in Bulacan.
