Activist files petition to suspend energy CS Wandayi over Ksh4.8 billion fuel scandal

Activist Francis Awino filed a petition at the Milimani High Court on Friday, April 10, 2026, seeking the suspension of Energy Cabinet Secretary Opiyo Wandayi over alleged involvement in the irregular procurement of substandard fuel worth Ksh4.8 billion. Awino wants urgent conservatory orders to bar Wandayi from exercising his powers and to hand over authority on fuel imports to an independent body under court supervision.

Activist Francis Awino filed an urgent petition at the Milimani High Court on Friday, April 10, 2026, seeking to suspend Energy Cabinet Secretary Opiyo Wandayi from office.
Awino claims Wandayi, as the sector head, presided over or was complicit in the unlawful importation of substandard petroleum products. The allegations include bypassing Pre-export Verification of Conformity (PVoC) requirements, importing non-compliant fuel, issuing questionable waivers, and blending substandard fuel with compliant stocks.

The petitioner argues these actions exposed consumers to unsafe products and undermined regulatory safeguards. Awino, who was attacked by goons last week, also seeks court orders to prevent Wandayi from interfering with investigations, witnesses, or evidence, and to restrict his decisions on petroleum matters.

Meanwhile, Wandayi has failed to honor parliamentary summons. The Energy Committee, chaired by Nakuru Town East MP David Gikaria, gave him another chance to appear on Thursday and warned of punitive measures like fines if he skips the fresh summons during their probe into the fuel importation process.

Energy and Petroleum Cabinet Secretary Opiyo Wandayi has assured Kenyans that the threat of substandard fuel from the ongoing Ksh4 billion procurement scandal has been contained, with supplies secure. This follows the arrests and resignations of four senior officials last week and the halting of a second suspicious shipment. EPRA has appointed Joseph Oketch as acting Director General.

The Orange Democratic Movement (ODM) has defended Energy CS Opiyo Wandayi and Trade CS Lee Kinyanjui against demands for their resignation following the KSh4.8 billion substandard fuel scandal, which led to arrests of senior officials earlier in the week. Party leader Oburu Odinga warned that public attacks could derail ongoing investigations.

Energy and Petroleum Cabinet Secretary Opiyo Wandayi has announced plans to establish long-term fuel reserves to shield Kenya from supply shocks. He made the remarks after appearing before a parliamentary committee on Monday, April 13, 2026. The country currently lacks formal reserves and depends on continuous imports.

Anthony Kibagendi, MP for Kitutu Chache South, has been suspended from parliament buildings indefinitely until he submits an apology letter. The suspension stems from his claims that parliament has been auctioned off and lost its independence. Speaker Moses Wetang’ula stated that these remarks undermine the institution's dignity.

Former Petroleum PS Mohamed Liban, ex-KPC MD Joe Sang, and former EPRA DG Daniel Kiptoo were released on police bail on April 6, 2026, days after their arrests and resignations in the Ksh4.8 billion irregular fuel importation scandal. Their lawyers denied wrongdoing, citing National Security Council recommendations, as the government moves to recover losses from importers.

Kenya Pipeline Company manager Pius Mwenda said the firm allowed fuel with high Sulphur levels following Minister Lee Kinyanjui's directive. This occurred on March 27, 2026, and was confirmed yesterday before the Energy Committee. The fuel was blended with other stocks to reduce risks.
