The Prosecutor's Office has sent the Supreme Court a report supporting a partial pardon for Álvaro García Ortiz, sentenced to two years of disqualification for disclosing reserved data. The document highlights the disproportionate extrapenal consequences of the conviction.
The report, prepared by deputy prosecutor Ángeles Sánchez Conde, states that the conviction has fulfilled its purpose by affirming the validity of criminal law. García Ortiz has already left the post of attorney general after the ruling and cannot be reappointed by law.
The Prosecutor's Office argues that the remaining disqualification lacks major practical relevance, since a new attorney general has been appointed. It highlights the absence of personal financial benefit and the aim to preserve the institution's reputation amid media attacks.
García Ortiz has paid the 10,000 euros in compensation to Alberto González Amador and the 7,200 euro fine. The request is limited to shortening the deadlines for canceling criminal records, without affecting the already paid compensation.
The Supreme Court will now prepare its own report, although the final decision rests with the Council of Ministers. The measure would be processed through a royal decree published in the Official State Gazette.
