The Attorney General's Office sent an opinion to the Federal Supreme Court on Thursday (18) against suspending the Dosimetry Law, which could reduce sentences for those convicted in the January 8, 2023 acts, including Jair Bolsonaro.
Attorney General Paulo Gonet defended the validity of the law approved by the National Congress. He argued that the text does not individualize beneficiaries and that Congress has autonomy to define criminal policies.
Gonet stated that the rule only alters criteria for sentencing and penal execution, without extinguishing punishability or eliminating the typicality of crimes. The opinion was sent to Minister Alexandre de Moraes, rapporteur of the actions questioning the legislation.
Actions were filed by parties such as PSOL, Rede, PT, PDT, PV and PCdoB, as well as the Brazilian Press Association. Moraes suspended the law's application in May pending a final plenary decision. The Attorney General's Office had already defended the unconstitutionality of the rule.
