Police Regulation No. 10 of 2025 has sparked controversy for not fully aligning with a Constitutional Court ruling. The Chairman of the Front Pemuda Indonesia Raya praises National Police Chief Listyo Sigit Prabowo for constitutional compliance, while Jimly Asshiddiqie highlights the lack of reference to the MK decision.
Police Regulation (Perpol) No. 10 of 2025 governs the assignment of active Polri members outside the police organizational structure, particularly in 17 ministries or state institutions. The regulation aims to affirm Constitutional Court (MK) Decision No. 114, which removes ambiguity in Article 28 paragraph (3) of Law No. 2 of 2002 on Polri.
On December 15, 2025, National Police Chief General Listyo Sigit Prabowo stated that the perpol clarifies the MK decision's clauses, including removing ambiguous phrases related to assignments by the Chief. "The clause there is already clear. And of course, improvements will be made," he said at the Presidential Palace Complex in Jakarta.
However, on December 17, 2025, Jimly Asshiddiqie, Chairman of the Polri Reform Acceleration Committee, criticized the perpol for not referencing the MK decision in its considerations and preambles. He noted it only refers to Law No. 2/2002, unaffected by the MK ruling, opening the door for judicial review at the Supreme Court. "Finding faults is easy; for example, look at the considerations in the preambles," he said.
Conversely, on December 18, 2025, FPIR General Chairman Fauzan Ohorella praised the perpol as constitutional compliance. He emphasized it establishes assignment mechanisms based on Polri members' duties and competencies, similar to Law No. 3 of 2025 on TNI. "We see this Perpol as General Listyo Sigit Prabowo's stance in obeying the Constitution," he stated.
This controversy underscores the need for legal clarity to avoid politicization, with cancellation options through the Chief or President Prabowo Subianto via executive regulations.
