The ruling stated that the captain engaged in non-consensual sexual conduct toward a resident doctor, constituting substantial wrongdoing in his dual role as specialist and instructor.
Following the appeal, the Ordinary Disciplinary Chamber for Judgment reviewed the evidence with a gender perspective and upheld the initial sanction. The behavior was classified as a very serious offense committed with intent.
