The ruling stated that the captain engaged in non-consensual sexual conduct toward a resident doctor, constituting substantial wrongdoing in his dual role as specialist and instructor.

Following the appeal, the Ordinary Disciplinary Chamber for Judgment reviewed the evidence with a gender perspective and upheld the initial sanction. The behavior was classified as a very serious offense committed with intent. This penalty aims to prevent recurrence of such actions, reaffirm institutional commitment to zero tolerance for sexual violence, and fulfill Colombia's state obligations for due diligence.
