Ombudsman prepared to absorb ICI amid latest resignation

Following recent resignations, including Commissioner Rossana Fajardo's effective December 31, the Office of the Ombudsman is ready to take over the Independent Commission for Infrastructure's (ICI) tasks, particularly the flood control scandal probe. This aligns with earlier signals of the ICI winding down.

Assistant Ombudsman Mico Clavano affirmed the Office of the Ombudsman's readiness to continue the ICI's investigations, describing the resignations as a 'natural progression' during the Ombudsman leadership transition from Samuel Martires to Jesus Crispin Remulla. The ICI, now left with only Chairman Andres Reyes Jr., Special Adviser Rodolfo Azurin Jr., and Executive Director Brian Keith Hosaka after departures including Fajardo, former DPWH Secretary Rogelio Singson, and Baguio City Mayor Benjamin Magalong, faces potential shutdown.

This follows Ombudsman Remulla's December 5 statement—previously countered by Reyes, who claimed a two-year mandate—that the ICI could conclude operations in one or two months, transferring all cases to his office. Critics, including Ateneo Policy Center's Michael Henry Yusingco, who called the ICI a 'waste of time and public funds' and a recommendatory redundancy, and former IBP president Domingo Cayosa, labeling it 'added bureaucracy,' echo concerns. Rep. Leila de Lima highlighted quorum issues, leaving Reyes effectively solo.

The scenario recalls the Supreme Court's 2010 strike-down of the Philippine Truth Commission. Political strategist Malou Tiquia noted President Marcos in a 'catch-22' over the ICI's setup.

Rossana Fajardo has resigned as commissioner of the Independent Commission for Infrastructure (ICI), effective December 31, 2025, leaving only three officials in the body. This follows the departure of former secretary Rogelio Singson and other members. The ICI will continue preparing final reports for the Ombudsman on irregular flood control projects.

Ombudsman Jesus Crispin Remulla said the Independent Commission for Infrastructure (ICI) might last only a month or two. However, ICI Chair Andres Reyes Jr. countered that the commission is set for two years of operation. The controversy stems from recent statements about the commission's powers and future.

Deputy Speaker Ronaldo Puno stated that the Independent Commission for Infrastructure (ICI) has fulfilled its mandate and should now hand over the investigation into corruption in flood control projects to the Office of the Ombudsman. He warned that simultaneous probes by multiple bodies could create confusion and erode public confidence. Puno praised the new leadership of the Ombudsman under Jesus Crispin Remulla for restoring credibility.

A criminology expert appeals to prosecutors to use Department Circular No. 20 to actively investigate and convict corrupt officials in flood control projects. This is part of broader efforts against infrastructure corruption that has caused significant harm to Filipinos' lives. Such action is crucial to break the cycle of impunity.

A recent Pulse Asia survey shows that 52 percent of Filipinos support the immediate passage of a law creating a fully empowered body to investigate alleged corruption in infrastructure projects. This proposed Independent Commission Against Infrastructure Corruption (ICAIC) would replace the current Independent Commission for Infrastructure (ICI) established by President Marcos via executive order. The poll indicates strong backing in Metro Manila and the Visayas, though support is lower in Mindanao.
