Power distributor Enel sent a letter to Aneel challenging the caducidade process for its São Paulo concession. The company requests suspension of the decision's effects pending appeal review and claims discriminatory treatment. Aneel did not respond to comment requests.
Enel formally requested reconsideration from the National Electric Energy Agency (Aneel) in a letter sent on Friday (24). The agency had unanimously decided, on April 7, by five votes, to initiate the caducidade process for the electricity distribution concession in São Paulo city. From that date, Enel has 30 days to present its defense, after which Aneel may recommend contract termination to the Ministry of Mines and Energy.
The company disputes the calculation of power restoration after a December 2025 blackout caused by an extratropical cyclone, which left over 1.3 million customers without electricity for more than 24 hours — 50,000 still without power six days later. Enel claims it restored service to 80.2% of affected customers within 24 hours, while Aneel figures 67%. The firm states the event was more severe than incidents in 2023 and 2024, and that the agency ignored an independent consultancy report confirming compliance with recovery targets.
Enel accuses Aneel of 'non-isonomic, discriminatory, and disproportionate' treatment, noting the 80% restoration target within 24 hours applies only to it, without regulatory basis. 'The imposition of a rigorous criterion on a single concessionaire [...] violates the principle of isonomy,' the letter states. The caducidade decision is publicly supported by Mayor Ricardo Nunes (MDB) and Governor Tarcísio de Freitas (Republicanos). Folha sought comment from Aneel on Saturday (25), with no response by publication.
