Gobierno envía al Congreso modificaciones a la Ley de Inocencia Fiscal

El Gobierno presentó un anteproyecto para modificar el régimen de inocencia fiscal con el objetivo de ampliar el acceso de contribuyentes y simplificar trámites. El ministro de Economía, Luis Caputo, anunció el envío de los cambios al Congreso.

Los cambios eliminan límites de ingresos y patrimonio para presentar la declaración jurada simplificada correspondiente al período fiscal 2025. Según el tributarista Marcelo Rodríguez, “se abre la puerta para que todos los contribuyentes, sin ningún tipo de distingo, puedan presentar” esa declaración.

Se establece un piso mínimo de cinco millones de pesos para que ARCA pueda cuestionar una declaración. Los contribuyentes tendrán quince días para ajustar y pagar lo propuesto sin perder el beneficio del tapón fiscal.

El tributarista Sebastián Domínguez señaló que la iniciativa otorga mayor seguridad jurídica al modificar el régimen mediante una ley aprobada por el Congreso. Destacó que se limitan las facultades de ARCA y se invierte la carga de la prueba.

El proyecto busca incentivar la incorporación de dólares no declarados al circuito formal. Rodríguez afirmó que permitirá “esterilizar los llamados dólares del colchón”.
