Court gives NEMA seven days to explain KSh1.3bn payment delay

The Environment and Land Court in Mombasa has ordered the National Environment Management Authority to explain delays in paying KSh1.3 billion in compensation to lead poisoning victims within seven days.

The court directed NEMA’s Director General to file an affidavit detailing steps taken to settle the award, reasons for the delay and a clear payment plan. The order follows a Supreme Court decision in December 2024 that upheld the KSh1.3 billion compensation for residents of Owino Uhuru slum affected by pollution from a lead-acid battery recycling plant.

Justice Bellinda Akello criticised the parties for delays and procedural shortcomings in handling the case. The court warned that failure to comply could result in bank funds being attached and released to the applicants.

The matter is scheduled to return to court on October 12 to confirm compliance. Parties may also negotiate and file a consent agreement on a payment schedule.
