Enel has filed a 119-page defense with Aneel challenging the process that could end its São Paulo concession contract. The Italian company claims the proceeding is null and its performance indicators exceed the national average.
The administrative process opened on April 7 after two years of discussions on service quality. Major blackouts struck in 2023, 2024 and on December 10 2025, leaving 4.4 million homes without power.
Enel disputes the agency's criticism of its response to extreme weather. It states it cut emergency response times by 50 percent since 2023, reaching 434 minutes against a national average of 443 minutes.
The concessionaire also reports R$ 1.5 billion invested in the first quarter of 2026, including R$ 690.3 million in the São Paulo metropolitan area. It requests expert analysis to assess whether the events were unprecedented and if it received unequal treatment compared with other distributors.
