Supreme Court directs OSG to submit unprogrammed funds documentation

Following initial oral arguments on April 7, the Supreme Court on April 8 asked the Office of the Solicitor General for detailed records on unprogrammed appropriations releases amid concerns over misuse in the 2024-2026 budgets. A April 14 deadline was set for the submission.

In continuation of oral arguments on petitions challenging the constitutionality of unprogrammed appropriations (UA) and budget insertions in the 2024-2026 General Appropriations Acts—after the April 7 session featuring amici curiae presentations—Senior Associate Justice Marvic Leonen on Tuesday directed Solicitor General Darlene Marie Berberabe to provide a comprehensive list of all special allotment release orders (SAROs) authorizing UA releases.

Leonen noted that SAROs are issued by the Department of Budget and Management to the Bureau of the Treasury for disbursement, and the OSG must align them with corresponding certificates of income from the Treasury.

The documents are due by April 14 and will inform interpellations in the second round of arguments scheduled for April 21. The request arises from ongoing suspicions of UA fund misuse.

Former senator Antonio 'Sonny' Trillanes IV and The Silent Majority group filed plunder and graft complaints against Vice President Sara Duterte at the Office of the Ombudsman on January 21, 2026, over alleged misuse of confidential funds. The accusations include P650 million from the Office of the Vice President and Department of Education, along with other anomalies from her past roles. This follows an earlier impeachment dismissed by the Supreme Court in July 2025.

The Supreme Court held its first oral arguments on April 7 on petitions challenging unprogrammed appropriations in the 2024, 2025, and 2026 national budgets. Invited experts as amici curiae presented divided views on their legality and implications. Some warned of weakened transparency, while others defended their necessity.

President Ferdinand Marcos Jr. vetoed a P43.24-billion allocation for personnel services in the 2026 national budget, sparking concerns among lawmakers over potential effects on government hiring.

The National Government carried out the transfer of the first twelfth of the General Purpose Participation of the General Participation System (SGP) for 2026, incorporating an additional 24% within the financial programming profile. This measure temporarily adjusts the programming of the first transfer of the year without changing the total annual amount assigned to territorial entities. The aim is to ease initial cash pressures stemming from the circumstances of the last twelfth of 2025.
