Toffoli returns MPF denunciation against Tanure to SP court

STF Minister Dias Toffoli returned an MPF denunciation against businessman Nelson Tanure to the Federal Court of São Paulo, over allegations of insider trading at Gafisa. Toffoli ruled there is no link to Banco Master investigations. The first-instance judge accepted the denunciation and declared Tanure a defendant.

Toffoli's Decision

On Tuesday, January 28, 2026, STF Minister Dias Toffoli returned to the 5th Federal Criminal Court of São Paulo a denunciation filed by the Ministério Público Federal (MPF) against businessman Nelson Tanure. The charges involve insider trading in the acquisition of incorporator Upcon by constructor Gafisa, between 2019 and 2020.

Toffoli, the rapporteur for Banco Master investigations at the STF, stated in his order that there is no connection between the Gafisa case and probes into the bank owned by Daniel Vorcaro, described as Tanure's financial arm. The denunciation had been sent to the STF just over a week earlier, at the end of December 2025.

Acceptance of the Denunciation

Upon returning to first instance, Judge Maria Isabel do Prado accepted the denunciation and declared Tanure a defendant. According to the MPF, Tanure and businessman Gilberto Benevides engaged in insider trading to inflate Upcon's market value. They allegedly made financial moves, including a R$150 million capital increase in Upcon days before the valuation, boosting its value by nearly 1,400%.

At the time, Tanure was a major Gafisa shareholder and board member since April 2019. Benevides controlled Upcon. The operations involved offshores in tax havens and the Singular Plus fund to hide stakes and secure guarantees.

Defense Response

Tanure's defense called the denunciation 'rushed.' Lawyer Pablo Naves Testoni stated in a note: "Businessman Nelson Sequeiros Rodriguez Tanure regrets once again the hasty denunciation presented by the Ministério Público Federal and is certain that the facts will be clarified in the course of the process."

The lawyers note that the Comissão de Valores Mobiliários (CVM) found no illegality in the deal, the Federal Police delegate found no crime indications, and the transaction was discussed by Gafisa shareholders. Tanure, an investor in companies like Prio, Dia, and Gafisa, was targeted by PF searches in Operation Compliance Zero in January 2026, which probes Banco Master for fraudulent management, market manipulation, and money laundering.

The case proceeds in São Paulo's court, without immediate ties to the STF's Master investigations.

The Federal Police requested the Supreme Federal Court to declare Minister Dias Toffoli recused as rapporteur in the Banco Master investigations, based on mentions of the magistrate found on Daniel Vorcaro's cell phone. The request was submitted to Court President Edson Fachin, who ordered Toffoli to respond. The minister's office described the request as unfounded allegations and questioned the PF's legitimacy.

Supreme Court Justice Dias Toffoli has ordered the Federal Police to take statements from individuals investigated in the Banco Master fraud case and Central Bank directors within 30 days. The action aims to clarify allegations and safeguard the National Financial System. The probe was moved to the STF following a defense request from an investigated party.

The Federal Police carried out the second phase of Operation Compliance Zero on Wednesday (14), with 42 search and seizure warrants against targets linked to Banco Master, including owner Daniel Vorcaro and businessman Nelson Tanure. The operation led to the temporary arrest of Vorcaro's brother-in-law and the seizure of assets worth millions. STF Justice Dias Toffoli, the case rapporteur, criticized the PF for delays but reconsidered decisions on the evidence.

Supreme Court Justice Alexandre de Moraes denied pressuring the Central Bank president in favor of Banco Master, embroiled in billion-dollar frauds. Reports indicate contacts between Moraes and Gabriel Galípolo, but both claim the meetings addressed the Magnitsky Act. The case has spotlighted judiciary ties and calls for investigation from opponents.

STF Minister André Mendonça reduced the secrecy level of the Banco Master fraud inquiry on Thursday (19), after taking over from Dias Toffoli. The decision grants the Federal Police broader access to seized materials and authorizes ordinary procedures, such as depositions. This reverses prior restrictions set by Toffoli.

The British magazine The Economist published an article stating that the Supreme Federal Court (STF) is involved in a 'huge scandal' due to suspicions of ties between ministers and banker Daniel Vorcaro, owner of Banco Master. The piece highlights close relations of judges like Dias Toffoli and Alexandre de Moraes with the business elite. The publication comes amid investigations and debates on creating an ethics code for the court.

Supreme Court Justice Gilmar Mendes suspended the breaking of banking, fiscal, and telematic seals for Maridt, a company in which Justice Dias Toffoli is a partner. The action responded to an order from the CPI on Organized Crime and was criticized in a Folha de S.Paulo editorial as an irregular maneuver. The decision relied on a 2021 archived writ of mandamus unrelated to the current case.
