STF Justice Flávio Dino published on Sunday (26) in Correio Braziliense the article "How to punish corruption in the Justice system?". He argues current ethical controls for judges, prosecutors, lawyers and others are insufficient and calls for revising the Penal Code.
The proposal has three main pillars. First, increase penalties for embezzlement, extortion, passive corruption, dereliction of duty, influence peddling and active corruption within the justice system. Second, immediate removal of judges, public prosecutors and lawyers upon indictment receipt, with automatic loss of position on final conviction. Dino wrote: "there is no sale of judicial decisions without a buyer".
The third pillar criminalizes actions impeding or retaliating investigations. He stresses the measure is proportional, stating it is "evidently reprehensible for a knower and guardian of legality to betray their robe or gown".
This fits a broader reform pushed by Dino, Gilmar Mendes, Alexandre de Moraes and Cristiano Zanin, opposing Edson Fachin, who prioritizes a code of conduct. The text emerges amid the Banco Master crisis involving STF justices.
