A three-judge bench has dismissed Rigathi Gachagua's petition against his impeachment while awarding him Sh50 million in damages.
On Monday June 8 2026 the High Court upheld the Senate decision to impeach former Deputy President Rigathi Gachagua. Justices Eric Ogolla Anthony Murima and Fridah Mugambi ruled that Parliament followed constitutional procedures throughout the process. The court rejected claims of bias and insufficient public participation. It however found that Gachagua was denied a fair hearing when the Senate refused an adjournment while he was in hospital thereby violating his right to be heard. As a result of that violation the judges awarded Gachagua Sh50 million in damages payable by the Senate. His removal from office stands so Professor Kithure Kindiki continues to serve as Deputy President.
