Inutusan ng Sandiganbayan Third Division si Sen. Rodante Marcoleta na ipaliwanag kung bakit hindi siya dapat masuspinde sa Senado. Inisyu ang utos noong Hulyo 22.

Binigyan ng dalawang pahinang utos ang kampo ni Marcoleta ng hindi maipagpapaliban na 10 araw mula sa abiso upang magsumite ng paliwanag. Ito ay batay sa Section 5 ng Republic Act 7080 o Anti-Plunder Act at sa revised internal rules ng Sandiganbayan.

Sa parehong araw, nagplead not guilty si Marcoleta sa mga kaso ng plunder at paglabag sa Presidential Decree 46 na nagbabawal sa mga opisyal na tumanggap ng regalo. Kasama niya sa pagplead not guilty ang co-accused na si Joseph Espiritu na nagbigay umano ng P20 million mula sa kabuuang P75 million na campaign donations.

Inihinto ni Marcoleta ang kanyang motion to quash sa plunder charge kaya nagpatuloy ang arraignment. Noong Hunyo, nagpataw ang Sandiganbayan Second Division ng 90 araw na preventive suspension kay Sen. Jinggoy Estrada dahil sa isang graft case.
