L'entourage de Duterte envisage de contester la compétence de la CPI à l'ONU après la décision sur la détention

À la suite de la décision de la Chambre d'appel de la CPI du 6 mars confirmant la détention de l'ancien président Rodrigo Duterte, son équipe juridique philippine, dirigée par Salvador Panelo, prévoit de soulever la question de la compétence de la cour auprès des Nations Unies. Panelo argue que la CPI n'a pas d'autorité sur l'affaire, soulignant qu'elle n'est pas un organe des Nations Unies.

Salvador Panelo, ancien conseiller juridique en chef de Duterte, a annoncé la stratégie lors d'un entretien avec Bilyonaryo News Channel, déclarant : « Comment la (CPI) peut-elle condamner (l'ancien président Duterte) si elle n'a pas de compétence ? C'est pourquoi je prévois de porter la question devant les Nations Unies. » Il a souligné que la CPI ne fait pas partie des Nations Unies et vise à publiciser toute potentielle injustice découlant d'une condamnation possible.  Panelo a également soutenu que l'affaire devrait être rejetée au fond, critiquant l'hypothèse de compétence de la CPI malgré ce qu'il considère comme son absence.  Ce développement intervient après que la Chambre d'appel de la CPI a unanimement confirmé l'ordonnance de la Chambre de première instance I du 26 janvier ordonnant la détention continue de Duterte, rejetant les arguments relatifs à un rapport médical (comme détaillé dans la couverture antérieure). Duterte, poursuivi pour crimes contre l'humanité incluant des meurtres liés à l'escouade de la mort de Davao et à sa campagne antidrogue, se trouve au centre de détention de la CPI depuis son arrestation aux Philippines en mars 2025.
