Supreme court accepts La Pampa claim on ATN funds

The Supreme Court of Justice of the Nation decided to intervene in the case filed by La Pampa against the National State over the distribution of National Treasury Contributions. The highest court gave the government 60 days to respond.

The court, composed of Horacio Rosatti, Carlos Rosenkrantz and Ricardo Lorenzetti, assumed original jurisdiction in the case under article 117 of the Constitution. The province, represented by Governor Sergio Ziliotto and State Attorney Romina Schmidt, challenges articles 3 subsection d and 5 of Law 23.548.

La Pampa argues that the 1% of the coparticipable mass allocated to the National Treasury Contributions Fund should be distributed automatically and daily among the provinces rather than remain under discretionary administration by the national Executive. The lawsuit also requests an informative and conciliation hearing.

The ruling notifies the Ministry of Economy and the Attorney General's Office. Fiscal Prosecutor Laura Mercedes Monti supported the direct intervention of the Court. The file does not yet resolve the constitutional merits of the issue.

The U.S. Court of Appeals for the Second Circuit in New York overturned on Friday the first-instance ruling ordering Argentina to pay over $16 billion for the 2012 YPF expropriation. President Javier Milei hailed the decision as a historic victory and criticized former Kirchnerist officials. The ruling averts a massive payout, though Burford Capital said it will appeal.

Javier Milei's government will authorize coparticipation fund advances to 12 provinces facing fiscal difficulties via decree, at a rate close to 15%. The measure addresses falling tax collections and aims to prevent salary payment issues. Officials note the rate is below market levels.

Argentina's Sala IV of the Contencioso Administrativo Federal Appeals Chamber ruled that the General Confederation of Labor (CGT)'s ongoing constitutional challenge to labor reform law 27.802 belongs in administrative jurisdiction, not labor courts. Judges Rogelio Vicenti and Marcelo Duffy sided with the national government in a win against the union confederation's efforts to block the reform, first challenged judicially in March.

The General Confederation of Labor (CGT) filed a judicial injunction against the labor reform promulgated on Friday by the Executive Power, numbered 27.802. The lawsuit, assigned to Judge Enrique Lavié Pico, seeks to declare null articles transferring labor competencies to the City of Buenos Aires. The labor federation plans another action in the labor court.

Colombia's Constitutional Court declared unfounded the recusals by several magistrates to review the economic emergency decree, which includes a wealth tax to address the winter crisis in Córdoba. The full chamber will continue its analysis tomorrow, April 29, after six magistrates recused themselves the previous day. Business leaders and President Gustavo Petro have reacted to the judicial review.

Following the U.S. appeals court's recent annulment of a $16 billion YPF expropriation ruling, Argentina gains partial relief from international litigation pressures. However, claims exceeding US$10 billion persist in cases involving debt, GDP-linked bonds, holdouts, Aerolíneas Argentinas, and related matters, amid reported government infighting.
