Supreme court accepts La Pampa claim on ATN funds

The Supreme Court of Justice of the Nation decided to intervene in the case filed by La Pampa against the National State over the distribution of National Treasury Contributions. The highest court gave the government 60 days to respond.

The court, composed of Horacio Rosatti, Carlos Rosenkrantz and Ricardo Lorenzetti, assumed original jurisdiction in the case under article 117 of the Constitution. The province, represented by Governor Sergio Ziliotto and State Attorney Romina Schmidt, challenges articles 3 subsection d and 5 of Law 23.548.

La Pampa argues that the 1% of the coparticipable mass allocated to the National Treasury Contributions Fund should be distributed automatically and daily among the provinces rather than remain under discretionary administration by the national Executive. The lawsuit also requests an informative and conciliation hearing.

The ruling notifies the Ministry of Economy and the Attorney General's Office. Fiscal Prosecutor Laura Mercedes Monti supported the direct intervention of the Court. The file does not yet resolve the constitutional merits of the issue.
