La Cour suprême accepte la plainte de La Pampa concernant les fonds ATN

La Cour suprême de justice de la Nation a décidé d'intervenir dans le dossier déposé par La Pampa contre l'État national au sujet de la répartition des Contributions au Trésor national. La plus haute instance judiciaire a accordé au gouvernement un délai de 60 jours pour répondre.

La Cour, composée d'Horacio Rosatti, Carlos Rosenkrantz et Ricardo Lorenzetti, a assumé une compétence originelle dans l'affaire en vertu de l'article 117 de la Constitution. La province, représentée par le gouverneur Sergio Ziliotto et l'avocate de l'État Romina Schmidt, conteste les articles 3 alinéa d et 5 de la loi 23.548.La Pampa soutient que le 1 % de la masse coparticipable alloué au Fonds des contributions au Trésor national devrait être réparti de manière automatique et quotidienne entre les provinces plutôt que de rester sous l'administration discrétionnaire de l'exécutif national. Le recours demande également la tenue d'une audience informative et de conciliation.La décision notifie le ministère de l'Économie et le bureau du procureur général. La procureure fiscale Laura Mercedes Monti a soutenu l'intervention directe de la Cour. Le dossier ne résout pas encore le fond constitutionnel de la question.
