La corte suprema acepta demanda de la pampa sobre los atn

La Corte Suprema de Justicia de la Nación decidió intervenir en la causa iniciada por La Pampa contra el Estado Nacional por la distribución de los Aportes del Tesoro Nacional. El máximo tribunal otorgó al Gobierno un plazo de 60 días para responder.

El tribunal, integrado por Horacio Rosatti, Carlos Rosenkrantz y Ricardo Lorenzetti, asumió la competencia originaria del caso según el artículo 117 de la Constitución. La provincia, representada por el gobernador Sergio Ziliotto y la fiscal Romina Schmidt, cuestiona los artículos 3 inciso d y 5 de la Ley 23.548.

La Pampa sostiene que el 1% de la masa coparticipable destinado al Fondo de Aportes del Tesoro Nacional debe distribuirse de forma automática y diaria entre las provincias, en lugar de quedar bajo administración discrecional del Ejecutivo nacional. La demanda también solicita una audiencia informativa y de conciliación.

La resolución notifica al Ministerio de Economía y a la Procuración General de la Nación. La procuradora fiscal Laura Mercedes Monti respaldó la intervención directa de la Corte. El expediente no resuelve aún el fondo de la cuestión constitucional.
