La justicia traslada causa de reforma laboral al fuero contencioso administrativo

La Sala IV de la Cámara de Apelaciones en lo Contencioso Administrativo Federal decidió que el reclamo de la CGT por la inconstitucionalidad de la reforma laboral se tramite en ese fuero, en lugar del laboral. La Sala IV de la Cámara de Apelaciones en lo Contencioso Administrativo Federal, integrada por los camaristas Rogelio Vicenti y Marcelo Duffy, determinó que la demanda de la CGT contra la reforma laboral es competencia exclusiva de ese fuero. El Gobierno, a través de la Procuración del Tesoro liderada por Sebastián Amerio, había exigido el cambio de jurisdicción, argumentando que los tribunales laborales no son adecuados para resolver conflictos contra resoluciones del Ejecutivo.

Los jueces criticaron duramente al juez laboral Mario Ojeda por su manejo "irregular" del expediente. Según la resolución, Ojeda omitió comunicar su rechazo a la inhibitoria y envió las actuaciones a la Cámara del Trabajo en vez de al tribunal competente, generando un conflicto innecesario. También desestimaron el dictamen del fiscal Rodrigo Cuesta, que pedía mantener el caso en el fuero laboral.

El tribunal destacó que la norma cuestionada, ley 27.802, involucra aspectos federales como el financiamiento del Fondo de Asistencia Laboral y competencias del Congreso, impactando al Estado como empleador.

Este fallo se suma a una victoria previa de la semana pasada, cuando la Cámara del Trabajo ordenó la plena vigencia de la reforma laboral, suspendida inicialmente por la CGT a pedido del Ejecutivo.
