Trabajo recurrirá la sentencia del Supremo que limita el acceso de inspectores a empresas

El Ministerio de Trabajo ha pedido a la Abogacía del Estado que recurra la sentencia del Tribunal Supremo del 14 de abril que exige autorización judicial para que los inspectores accedan a centros de trabajo que coinciden con el domicilio social de las empresas.

La decisión del alto tribunal afecta principalmente a pymes donde el centro de trabajo y el domicilio social coinciden. El ministerio dirigido por Yolanda Díaz considera que la sentencia limita la actuación de la Inspección de Trabajo y Seguridad Social.

Fuentes ministeriales indicaron que, a la espera del recurso por vía de incidente de nulidad, la Inspección sigue actuando con normalidad. Los inspectores podrán entrar en los centros de trabajo salvo en espacios de dirección o custodia de documentación, donde se requerirá consentimiento o autorización judicial.

Los sindicatos de inspectores, como SITSS y UPIT, así como CCOO, han criticado la sentencia por dificultar las inspecciones sorpresa y comprometer la protección de los derechos laborales. El fallo surgió de un caso en la Comunidad Valenciana donde una empresa recurrió la entrada de inspectores junto a la Policía Nacional.
