La Audiencia Nacional establece que los festivos en sábado deben compensarse

La Audiencia Nacional ha dictado una sentencia que obliga a compensar los días festivos que coincidan con el descanso semanal en sábado. La resolución responde a un conflicto colectivo en el sector de los centros de atención al cliente.

La sentencia de la sala de lo social, fechada el 19 de mayo, declara que las empresas no pueden absorber los festivos cuando coinciden con el sábado. Otorga a los trabajadores el derecho a un día adicional de descanso efectivo.

La Audiencia Nacional dio la razón a los sindicatos USO, CGT, UGT y CCOO en sus demandas contra la Asociación de Compañías de Experiencia con Cliente. Se adhirieron también CIG, CSIF y STC.

USO afirmó que la resolución consolida la doctrina que impide a las empresas eliminar festivos mediante cuadrantes de trabajo. La secretaria de Acción Sindical y Empleo de USO, Sara García, declaró que los catorce festivos anuales deben disfrutarse plenamente por todas las personas trabajadoras.

El Tribunal Supremo ya fijó criterios similares en abril de 2025, aunque sin abordar específicamente los sábados. La nueva sentencia puede recurrirse ante el alto tribunal.
