Audiência Nacional determina que feriados que caem no sábado devem ser compensados

A Audiência Nacional da Espanha determinou que as empresas devem compensar os trabalhadores por feriados que coincidem com seu dia de descanso semanal, no caso, o sábado. A decisão decorre de um conflito coletivo no setor de contact centers.

A sentença da câmara social, datada de 19 de maio, estabelece que as empresas não podem absorver os feriados quando estes coincidem com o descanso de sábado. A decisão concede aos trabalhadores o direito a um dia adicional de folga efetiva.

A Audiência Nacional ficou ao lado dos sindicatos USO, CGT, UGT e CCOO em suas reivindicações contra a Asociación de Compañías de Experiencia con Cliente. CIG, CSIF e STC também participaram do processo.

O USO afirmou que a decisão consolida a jurisprudência que impede as empresas de eliminar feriados por meio de escalas de trabalho. A secretária de ação sindical e emprego do USO, Sara García, declarou que todos os catorze feriados anuais devem ser plenamente desfrutados por cada trabalhador.

O Tribunal Supremo já havia estabelecido critérios semelhantes em abril de 2025, embora sem abordar especificamente os sábados. A nova sentença ainda pode ser recorrida à instância superior.
