Ministério do Trabalho recorrerá de decisão da Suprema Corte que limita acesso de fiscais a empresas

O Ministério do Trabalho solicitou à Advocacia-Geral do Estado que recorra da decisão da Suprema Corte de 14 de abril, que exige autorização judicial para que fiscais acessem locais de trabalho que coincidam com a sede social de uma empresa.

A decisão do tribunal superior afeta principalmente as PMEs, onde o local de trabalho e a sede social coincidem. O ministério liderado por Yolanda Díaz acredita que a sentença restringe as operações da Inspeção de Trabalho e Seguridade Social.

Fontes do ministério informaram que, enquanto aguarda o recurso por meio de um incidente de nulidade, a inspeção continua operando normalmente. Os fiscais podem entrar nos locais de trabalho, exceto em áreas de administração ou armazenamento de documentos, onde será necessário consentimento ou autorização judicial.

Sindicatos de fiscais, como o SITSS e o UPIT, juntamente com o CCOO, criticaram a decisão por dificultar inspeções surpresa e comprometer a proteção dos direitos trabalhistas. A decisão surgiu a partir de um caso na Comunidade Valenciana, onde uma empresa contestou a entrada de fiscais acompanhados pela Polícia Nacional.
