Após decisão judicial, SIC nega perícia à Dimayor em caso de cartel

A Superintendência de Indústria e Comércio rejeitou o pedido da Dimayor para que um perito de informática revisasse provas digitais em uma investigação sobre suposto conluio no mercado de transferências de jogadores.

O caso teve origem em 2021 com uma investigação contra 17 clubes, a Dimayor e 20 dirigentes por supostamente controlarem o mercado de transferências, violando as regras de livre concorrência.

A SIC negou a perícia argumentando que as provas já haviam sido verificadas e que as partes investigadas não utilizaram os meios legais anteriores para contestá-las. A entidade respondeu a uma ordem de março de 2026 do Tribunal Constitucional.

O Tribunal havia decidido a favor da Dimayor após uma tutela alegando violação do devido processo legal, já que a SIC não tinha se pronunciado sobre o pedido antes de encerrar a fase probatória em dezembro de 2024.

A superintendente Cielo Rusinque confirmou que a SIC entrou com uma ação de nulidade contra a decisão do Tribunal para proteger os direitos dos jogadores contra práticas anticompetitivas.
