NCC encaminha FlySafair ao tribunal nacional do consumidor por overbooking

A Comissão Nacional do Consumidor encaminhou a FlySafair ao Tribunal Nacional do Consumidor, citando conduta desonesta em suas práticas de overbooking de voos. A medida segue uma investigação que cobriu reservas de novembro de 2024 a janeiro de 2025. Mais de 5.000 passageiros foram afetados mensalmente durante esse período.

A comissão afirma que a companhia aérea violou vários artigos da Lei de Proteção ao Consumidor, incluindo o artigo 47, que exige que os fornecedores reembolsem os consumidores ou forneçam serviços equivalentes quando não puderem cumprir os termos acordados. A FlySafair sustenta que agiu legalmente. O chefe de marketing, Kirby Gordon, declarou que os fatos mostrarão que a companhia aérea seguiu as orientações das notas consultivas do Ombudsman de Bens e Serviços de Consumo sobre overbooking. A comissão busca uma penalidade de até 10 por cento do faturamento anual da companhia aérea. A FlySafair oferece aos passageiros afetados um reembolso total ou R$ 1.000 em compensação quando são impedidos de embarcar em um voo.
