Delhi High Court: EWS cannot claim age relaxation or extra attempts like SC/ST/OBC

The Delhi High Court has ruled that aspirants from the Economically Weaker Section (EWS) cannot seek parity with SC/ST/OBC candidates for relaxations in upper age limits or number of attempts in Central government appointments. Justices Anil Kshetarpal and Amit Mahajan noted that the handicaps faced by socially backward and economically deprived classes differ.

A bench of the Delhi High Court dismissed pleas by EWS aspirants seeking age relaxations and additional attempts in Central government recruitment processes.

Justices Anil Kshetarpal and Amit Mahajan stated, “The EWS category cannot claim automatic parity with SC/ST/OBC in ancillary considerations such as age relaxation or enhanced attempts.” They emphasized that handicaps of socially backward classes differ from those of economically deprived ones.

The ruling came on April 17, 2026, clarifying distinctions between social backwardness and economic deprivation in reservation benefits.

The Karnataka cabinet on Friday approved a revised system of sub-quotas for Scheduled Castes within the 15% overall reservation, allocating 5.25% each to right-hand and left-hand Dalit groups and 4.5% to other SC categories. The decision came at a special cabinet meeting and will enable recruitment for thousands of stalled government posts. Chief Minister Siddaramaiah called it a historic move.

The Supreme Court of India ruled on March 11 that parental income alone cannot determine if an OBC candidate falls under the creamy layer, particularly for those whose parents work in public sector undertakings or private employment. This judgment addresses long-standing confusion over income calculations for reservation eligibility. It provides relief to affected candidates from civil services exams since 2015.
