Korti yaruhusu wakazi kuendelea na kesi ya kudai ardhi ya Mama Ngina na Basil Criticos

Mahakama ya Mazingira na Ardhi imeruhusu zaidi ya wakazi 440 wa Kachero, Kaunti ya Taita Taveta, kuendelea na kesi yao ya kudai umiliki wa ardhi inayomilikiwa na Mama Ngina Kenyatta na Basil Criticos.

Wakazi hao wanataka kutambuliwa haki yao ya makazi kwenye ardhi hiyo, wakieleza kuwa hawapingi umiliki wa Bw. Criticos bali wanataka ahadi iliyotolewa kwao itimizwe. Kesi inahusisha pia Tume ya Ardhi ya Kitaifa, Msajili Mkuu wa Ardhi na Mwanasheria Mkuu.

Mahakama ilisema hakuna kesi kama hii iliyowahi kuamuliwa awali, na kwamba kesi hii ni ya kikatiba inayohusu haki za mali na makazi. Ilibainisha kuwa kesi za awali zilizotajwa na Bw. Criticos, zikiwemo ile ya mwaka 2023 iliyoamuliwa Desemba 2025, hazifanani na hii kwa sababu wahusika, hoja na maombi ni tofauti.

Bw. Criticos alipinga ombi hilo kupitia wakili wake, akisema ardhi ni ile ile na Msajili Mkuu wa Ardhi ni mshtakiwa katika kesi zote. Mahakama iliamuru pande zote kuwasilisha majibu na kupanga tarehe ya kusikilizwa kwa kesi hiyo.
